2.2 Your licence to us (user submissions)

If you submit, upload, or share content with us (e.g., comments, testimonials, case studies, forum posts, images, videos, or feedback) you represent that you have the necessary rights and that such content does not infringe third-party rights. You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, adapt, publish, translate, distribute, and display that content for the purposes of operating and improving the Site and our services, including marketing (e.g., showcasing outcomes or testimonials), unless you revoke consent for marketing use by emailing [email protected].

We may, but are not obligated to, monitor, edit, or remove submissions at our discretion.

2.3 Linking and framing

3) Accounts & Access

To use certain features, you may need to create an account and set a password. You are responsible for maintaining the confidentiality of your login details and for all activities under your account. Inform us immediately of any unauthorised use.

We may suspend or terminate access if we reasonably believe you have breached these Terms or applicable law.

4) Acceptable Use

You must not:

Interfere with or disrupt the Site, its security, or any related networks;

Introduce malware, scrape content, or attempt unauthorised access;

We may remove content and/or suspend access where reasonably necessary to protect our users, comply with law, or safeguard our systems.

5) Services, Orders, and Subscriptions

5.1 Scope of services

We provide AI-assisted marketing systems, paid advertising management, funnel building, analytics, automation, consulting, training, and community access (collectively, “Services”). Specific deliverables, timelines, and service levels (if any) are defined in the applicable order form, statement of work, or online checkout (“Order”).

5.2 Fees & payment

You agree to pay the fees specified in your Order. Unless stated otherwise, prices are exclusive of VAT and other applicable taxes. We may use third-party processors (e.g., Stripe) to collect payments. You authorise us (and our processors) to charge your selected payment method for recurring subscriptions and usage-based or one-off fees, as applicable.

If a payment fails, we may suspend access until the billing issue is resolved. Late or overdue amounts may accrue interest at the legal rate under applicable law and you will reimburse reasonable collection costs.

5.3 Term, renewal & cancellation

Subscription terms and renewal periods are stated in your Order. Unless cancelled in accordance with the Order terms, subscriptions renew automatically. You may cancel future renewals via your account or by emailing [email protected] within the stated notice period. Fees already paid are non-refundable unless your Order explicitly provides otherwise.

5.4 Refund policy

Each program, event, or package states its own refund policy at the point of sale. If no refund terms are stated, fees are non-refundable.

5.5 Trials & promotions

Trials, discounts, and promotional offers are subject to their stated terms and may be modified or withdrawn at any time.

6) Third-Party Tools & Integrations

Our Services may integrate with or reference third-party platforms (e.g., Meta, Google, ClickFunnels, GoHighLevel, Hyros, Calendly, Slack, Zapier, Skool, Stripe, WhatsApp Business). Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party services and do not guarantee their availability or performance.

You are responsible for maintaining required permissions and access in your ad accounts, business managers, domains/DNS, messaging channels, and CRMs. We are not liable for delays or performance issues caused by missing permissions, platform restrictions, or policy/verification failures.

7) Results, Disclaimers & Warranties

Marketing performance depends on many factors outside our control (market conditions, offer, pricing, creative assets, targeting, platform policies, sales operations, follow-up, etc.). We do not guarantee any particular results, revenue, profit, or return on ad spend.

The Site and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties (express, implied, or statutory), including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, secure, error-free, or free of harmful components.

8) Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (e.g., liability for death or personal injury caused by negligence, or for fraud).

To the maximum extent permitted by law:

We shall not be liable for any loss of profit, revenue, business, contracts, anticipated savings, goodwill, data, or for any indirect or consequential loss.

Our aggregate liability arising out of or in connection with the Site and Services (whether in contract, tort, negligence, or otherwise) shall be limited to the total fees you paid to us in the 12 months preceding the event giving rise to the claim.

You agree to indemnify us against claims, losses, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, unlawful use of the Site/Services, or infringement of third-party rights.

9) Compliance, Data & Privacy

Your use of the Site and Services must comply with applicable laws (including advertising rules, consumer protection, e-commerce, intellectual property, and privacy/data protection laws). You are responsible for the lawfulness of the data you provide to us (e.g., contact lists) and for obtaining necessary consents.

Our processing of personal data is governed by our Privacy Policy. Where we process personal data on your behalf as a processor, a Data Processing Addendum (DPA) may apply; if you require a signed DPA, contact [email protected].

You must implement and maintain compliant cookie/consent banners and privacy notices on your own properties where required.

10) Notice & Takedown (Content Complaints)

If you believe material on the Site infringes your rights or is unlawful, please notify [email protected] with:

Your contact details;

A description and precise URL of the content;

The legal basis of your complaint; and

A statement in good faith that your notice is accurate and you are authorised to act.

We will review and act where appropriate in accordance with EU and Belgian law.

11) Community & Interactive Features

Community areas (e.g., forums, chats, groups) are provided to support learning and collaboration. We may moderate but are not obligated to do so. We may remove content or suspend access for behaviour that violates these Terms or harms other users. Community content represents the views of the respective contributors only.

12) Confidentiality

Where the parties share non-public business, technical, or strategic information, each party will protect the other’s confidential information with reasonable care and use it only for the intended engagement, except where disclosure is required by law.

13) Force Majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control (including outages or policy changes by ad platforms, DNS/hosting failures, cyber incidents, strikes, war, government actions, or natural events).

14) Termination

We may suspend or terminate access to the Site or Services if you materially breach these Terms or your Order and, where remediable, you fail to remedy within a reasonable period after notice. Upon termination, your right to access applicable Services ceases. Provisions that by their nature should survive (e.g., intellectual property, fees, confidentiality, disclaimers, liability, governing law) will continue.

15) Governing Law & Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by Belgian law. The courts of Antwerp, Belgium shall have exclusive jurisdiction, subject to mandatory consumer venue rights (if applicable).

If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Our preference is to resolve issues amicably—please contact [email protected] first.

16) Miscellaneous

Entire agreement: These Terms, the Privacy Policy, and your Order constitute the entire agreement.

No waiver: A failure to enforce a provision is not a waiver.

Severability: If a provision is unlawful or unenforceable, the remainder remains in effect.

Assignment: You may not assign or transfer your rights without our written consent. We may assign to an affiliate or in connection with a merger, sale, or reorganisation.

Notices: We may provide notices via the Site, email, or your account dashboard.
